These Terms of Service (hereinafter — the "Terms") govern the use of the GlowNow platform (hereinafter — the "Platform"), operated by GlowNow LTD (Israel). By accessing or using the Platform, you agree to be bound by these Terms.

1. Definitions

• "Platform" — the GlowNow web application, including the CRM system for businesses and the client booking application.
• "Business User" — a beauty salon, studio, or individual professional who uses the Platform to manage appointments and clients.
• "Client User" — an end user who books appointments through the Platform.
• "User" — any person who accesses or uses the Platform, including both Business Users and Client Users.

2. Eligibility

You must be at least 16 years old to use the Platform. By using the Platform, you confirm that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

• To use certain features of the Platform, you must create an account by providing accurate and complete information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Services Provided

The Platform provides the following services:

• For Business Users: appointment calendar, client management (CRM), analytics, AI-powered WhatsApp assistant, automated reminders, Google Calendar synchronization, and billing management.
• For Client Users: salon discovery, online appointment booking, booking history, and appointment reminders.

5. Acceptable Use

When using the Platform, you agree not to:

• Violate any applicable laws or regulations.
• Infringe upon the rights of others, including intellectual property rights.
• Upload or transmit malicious code, viruses, or harmful content.
• Attempt to gain unauthorized access to the Platform or its systems.
• Use the Platform for spamming, phishing, or other fraudulent activities.
• Interfere with or disrupt the Platform's functionality.
• Collect personal data of other users without their consent.

6. Subscription and Payments

• Business Users may be required to subscribe to a paid plan to access certain features.
• Subscription fees are billed in advance on a recurring basis (monthly or annually).
• All fees are non-refundable unless otherwise stated or required by law.
• We reserve the right to change pricing with reasonable notice to existing subscribers.
• Failure to pay may result in suspension or termination of access to paid features.

7. Intellectual Property

• The Platform, including its design, code, logos, and content, is the intellectual property of GlowNow LTD.
• You may not copy, modify, distribute, or create derivative works based on the Platform without our written consent.
• Content you upload to the Platform remains your property, but you grant us a license to use it for providing and improving the Platform.

8. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

9. AI Assistant

• The Platform may include an AI-powered assistant for automated communication with clients via WhatsApp.
• The AI assistant operates based on the business settings and data provided by Business Users.
• We do not guarantee the accuracy of AI-generated responses and recommend Business Users review and customize the assistant's behavior.
• Business Users are responsible for ensuring their use of the AI assistant complies with applicable communication laws.

10. Limitation of Liability

• The Platform is provided "as is" and "as available" without warranties of any kind.
• We do not guarantee uninterrupted, error-free, or secure access to the Platform.
• To the maximum extent permitted by law, GlowNow LTD shall not be liable for any indirect, incidental, special, or consequential damages.
• Our total liability shall not exceed the amount paid by you for the Platform in the 12 months preceding the claim.

11. Termination

• You may terminate your account at any time by contacting us.
• We may suspend or terminate your access if you violate these Terms or for any other reason with reasonable notice.
• Upon termination, your right to use the Platform ceases immediately.
• We may retain certain data as required by law or for legitimate business purposes.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the State of Israel. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Israel.
